Agreement to Terms

These Terms of Use (“Terms”) govern your access to and use of the website raisingthinkers.com.au (“the Website”), all digital products, online courses, downloadable resources, and related services (collectively, “the Services”) provided by Raising Thinkers Pty Ltd (ABN: [Insert ABN]), trading as Raising Thinkers (“we”, “us”, “our”).

By accessing the Website, downloading any of our resources, subscribing to our email list, or purchasing any of our programs, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

If you are purchasing or using our Services on behalf of a child, you confirm that you are the child’s parent or legal guardian, that you are at least 18 years of age, and that you accept these Terms on behalf of both yourself and your child.

About Our Services

Raising Thinkers provides educational programs, guides, and resources designed to support Australian families through the transition from primary school to secondary school. Our Services include, but are not limited to:

  • Free downloadable guides and PDF resources

  • Paid online courses and program modules (including The Bridge Program)

  • Video lessons, worksheets, and printable activities for parents and children

  • Email communications, including tips, tools, and program-related sequences

  • Subscription-based ongoing content and support

Our programs include content designed for children aged 10–13, which is accessed through the parent’s account and under the parent’s supervision. Children do not create their own accounts and are not required to provide any personal information.

Eligibility

To use our Services, you must:

  • Be at least 18 years of age

  • Be the parent or legal guardian of the child for whom you are accessing child-directed content

  • Provide accurate and complete information when creating an account or making a purchase

  • Use our Services in accordance with all applicable Australian laws and regulations

Children under 18 may access our child-directed content only under the supervision and with the consent of their parent or legal guardian. At no point do we knowingly allow children to independently purchase, subscribe to, or manage an account with our Services.

Accounts and Access

When you create an account with us (for example, through our course platform), you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you become aware of any unauthorised use of your account.

Your account is personal to you. You may share access with your child for the purpose of accessing child-directed content within the program you have purchased, but you may not share your login credentials with other families, individuals, or organisations.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms, shared your account credentials with unauthorised third parties, or used our Services in a manner that is harmful, abusive, or inconsistent with their intended purpose.

Purchases and Payment

All prices on our Website are displayed in Australian Dollars (AUD) unless otherwise stated. Prices are inclusive of GST where applicable.

Payments are processed securely through Stripe. We do not store your credit card or payment details on our servers. By completing a purchase, you authorise us to charge the applicable fee to your chosen payment method.

For subscription-based products (such as The Bridge Continues), your subscription will automatically renew at the end of each billing period at the then-current price unless you cancel before the next renewal date. You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period; no partial refunds will be issued for unused portions of a billing period.

We reserve the right to change our prices at any time. Any price changes will not affect purchases already completed or active subscriptions until the next renewal date.

Refund Policy

We want every family to have a positive experience with our programs. Our refund policy is designed to be fair to both our customers and our business, and complies with the Australian Consumer Law.

6.1 Digital Products and Online Courses

Because our products are digital and delivered immediately upon purchase, we offer refunds under the following conditions:

  • Within 30 days of purchase: If you are unsatisfied with the program and have not completed more than 25% of the course content, you may request a full refund by emailing [email protected]. Please include your name, email address used at purchase, and a brief reason for your request.

  • After 30 days or after completing more than 25% of the content: Refunds are generally not available, as the digital content has been substantially delivered and consumed.

  • Technical issues: If you experience a technical issue that prevents you from accessing purchased content and we are unable to resolve it within a reasonable timeframe, you are entitled to a full refund regardless of timeframe.

6.2 Free Resources

Free downloadable resources (such as PDF guides) are provided at no cost and are non-refundable.

6.3 Australian Consumer Law Guarantees

Nothing in this refund policy limits or excludes any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Under the Australian Consumer Law, consumers are entitled to a remedy (repair, replacement, or refund) if a product or service fails to meet a consumer guarantee. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Intellectual Property

7.1 Our Content

All content on our Website and within our programs — including but not limited to text, videos, images, audio, worksheets, printable activities, PDF guides, course materials, logos, trademarks, and overall design — is the intellectual property of Raising Thinkers Pty Ltd and is protected by Australian and international copyright and intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of our content except as follows:

  • You may download and print worksheets and PDF guides included in your purchased program for personal, non-commercial use within your own family

  • You may share short excerpts of our free content on social media, provided you credit Raising Thinkers and link back to our Website

  • You may not share, forward, upload, or otherwise distribute paid course content (including videos, PDFs, and worksheets) to anyone who has not purchased the program

7.2 Your Content

If you submit feedback, testimonials, reviews, survey responses, or other content to us (“User Content”), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display that content for the purposes of marketing, improving our Services, and sharing with prospective customers. We will never use your User Content in a way that identifies your child without your explicit written consent.

7.3 Prohibited Uses

You may not use our content for any of the following purposes:

  • Reselling, sublicensing, or commercially distributing our programs or materials

  • Using our content to create a competing product, course, or service

  • Sharing course login credentials with individuals outside your immediate household

  • Recording, screen-capturing, or otherwise reproducing our video content

  • Using our branding, trademarks, or logos without prior written permission

Children’s Content and Parental Responsibility

Our programs include content specifically designed for children aged 10–13 (“Child Content”). This content is provided for educational and personal development purposes and is intended to be accessed under the guidance of a parent or guardian.

8.1 Parental Supervision

While our Child Content is designed to be age-appropriate and independently engaging for children in the target age range, parents are ultimately responsible for determining whether specific content is suitable for their individual child. We recommend that parents review the content alongside their child, particularly during the first module.

8.2 No Direct Relationship with Children

Our contractual relationship is with you, the parent or guardian. We do not enter into any agreement, contract, or direct relationship with your child. All communications, account management, payments, and support interactions are conducted with the parent or guardian.

8.3 Content Suitability

Our Child Content addresses topics related to emotional wellbeing, identity, social dynamics, resilience, and the school transition experience. Some content may touch on sensitive topics such as peer pressure, social exclusion, and emotional distress. These topics are handled in an age-appropriate, constructive, and supportive manner. However, if you have concerns about the suitability of any content for your child’s specific circumstances, please contact us before or during your enrolment.

Disclaimers

9.1 Educational Content Only

Our programs, guides, and resources are provided for general educational and informational purposes only. They do not constitute and should not be relied upon as medical, psychological, therapeutic, or professional advice. Our content is not a substitute for professional consultation with a qualified psychologist, counsellor, therapist, or other healthcare provider.

9.2 No Guaranteed Outcomes

While our programs are designed based on research-informed principles and real parenting experience, every child and family is unique. We cannot guarantee specific results, behavioural changes, or outcomes from using our content. Testimonials and case studies shared on our Website represent individual experiences and are not guarantees of future performance.

9.3 Not Therapy or Clinical Intervention

The Bridge Program and all Raising Thinkers content are not therapy, counselling, or clinical intervention. If your child is experiencing significant mental health challenges, including but not limited to persistent anxiety, depression, self-harm, school refusal, or disordered eating, we strongly recommend seeking support from a qualified mental health professional. Our programs are designed to complement, not replace, professional support.

9.4 Third-Party Links and Services

Our Website and programs may contain links to third-party websites, tools, or services (such as our course platform, payment processor, or recommended resources). We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of third-party services is governed by their respective terms and conditions.

Limitation of Liability

To the maximum extent permitted by law, Raising Thinkers Pty Ltd, its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services, including but not limited to loss of profits, data, or other intangible losses.

Our total liability to you for all claims arising from or related to these Terms or our Services is limited to the amount you paid to us for the specific product or service giving rise to the claim.

Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

Indemnity

You agree to indemnify and hold harmless Raising Thinkers Pty Ltd, its directors, employees, and contractors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of our Services, your violation of these Terms, or your infringement of any third-party rights.

Acceptable Use

When using our Services, you agree not to:

  • Use our Services for any unlawful or fraudulent purpose

  • Harass, abuse, or harm other users, our staff, or any other person

  • Upload or transmit any harmful code, viruses, or other destructive content

  • Attempt to access, interfere with, or disrupt our Website, servers, or connected systems

  • Use automated systems (such as bots or scrapers) to access our content

  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity

  • Use our Services in any manner that could damage, disable, overburden, or impair the functioning of our Website or Services

Email Communications and the Spam Act

By providing your email address to us — whether through downloading a free resource, making a purchase, or subscribing to our list — you consent to receiving email communications from Raising Thinkers. These emails may include program-related content, tips and resources, and information about our products and services.

All email communications comply with the Spam Act 2003 (Cth). Every email includes a clear and functional unsubscribe link. If you unsubscribe, we will remove you from our marketing list within 5 business days. Transactional emails (such as purchase confirmations and account notifications) may still be sent as required.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of South Australia, Australia. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of South Australia.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make material changes, we will update the “Last updated” date at the top of this document and, where appropriate, notify you by email. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any additional terms applicable to specific products or services, constitute the entire agreement between you and Raising Thinkers Pty Ltd with respect to your use of our Services.
